Hale v. Citibank

ZEK successfully represented one of its banking clients in defeating an application for class certification. The action involved claims of violations of certain disclosure in advertising provisions in the Truth and Lending Act. ZEK successfully argued that the putative class representative's relationship to class counsel through her husband created an irreconcilable conflict of interest rendering class certification improper. (Hale v. Citibank, 198 F.R.D. 606 S.D.N.Y. 2001)
