Stuart Krause and Bruce Goodman Speak to Association of Corporate Counsel in Israel about International Arbitration and Mediation

NEW YORK -- With the State of Israel increasingly involved in international trade and with an increased emphasis on settling disputes through arbitration and mediation, two attorneys from the Manhattan-based firm of Zeichner Ellman & Krause LLP recently made a presentation to the Association of Corporate Counsel in Israel. The topic was “International Commercial Arbitration and Mediation.”

“Cost is increasingly of concern to Israeli corporate counsel. This mirrors a trend to lowering litigation costs in the U.S., and both arbitration and mediation can avoid expensive and lengthy litigation,” said Stuart Krause, who made the presentation along with Bruce Goodman. Both attorneys have spent considerable time in Israel and are familiar with the country, language, customs and business climate.

Krause’s presentation focused on mediation. He said that Israel’s legal climate is amenable to mediation and courts are requiring parties to mediate disputes before litigation.

“In Israel, arbitration and mediation are becoming larger issues as the Israeli economy grows,” Krause said. “With Israel’s economy expanding internationally, Israeli corporations need and want to be prepared. This was the first presentation of the association devoted to these topics. Previous presentations mainly focused on transactional issues and doing business in the United States.”

Goodman discussed international arbitration and the need to carefully draft arbitration clauses to prevent disputes over wording and intent when arbitration takes place.

“Arbitration can be a cost-efficient way to resolve disputes, and a company can better control its litigation costs if the process is set up correctly, and the appropriate venue selected, instead of taking the risk that the company will be before a foreign country’s court, which may be biased against Israeli companies,” he said.

More than 50 corporate counsel, including several from some of Israel’s largest corporations, attended the event at the Sheraton Moriah in Tel Aviv.
