Compliance - AML/BSA/Legal Process

As part of our broad representation of financial services organizations, we have expertise in the Anti-Money Laundering (“ AML”), Anti-Terrorist Financing and Bank Secrecy Act area. The USA PATRIOT Act has greatly increased the burdens on financial institutions and others to develop and maintain proper AML and related controls. We stay on the cutting edge of this rapidly developing area through our regular representation of clients and contact with governmental authorities. As a result, we have been asked regularly to appear and make presentations to industry groups and participate in continuing education seminars on AML, Anti-Terrorist Financing, and Bank Secrecy Act compliance.

As the requirements of the Bank Secrecy Act and the USA PATRIOT Act expand to include industries outside the traditional financial services sector, new compliance obligations will begin to burden businesses that may be unprepared. We are available to assist clients in this regard.

We represent clients regularly in responding to inquiries, examinations, and investigations conducted by prosecutors, legislative bodies and regulators relating to AML and Terrorist Financing issues. Working with our clients we develop strategies to respond to the myriad risks that such investigations can pose and work to develop and maintain compliance procedures.

In addition, we have for many years advised clients on privacy issues and those involving compliance with various forms of legal process from governmental or private parties. In that connection, we know well and advise clients concerning the intricacies of requests for federal and/or state restraints sought against property held by our institutional clients for others.
