ZEK has an active practice representing
major commercial insurers in a broad range of matters. We
represent insurers and premium finance companies seeking to
collect retro-premiums, loss reimbursement obligations, reinsurance
balances, captive balances and premium finance loans. We represent
insurers in state, federal and bankruptcy courts, and in arbitration.
The Firm has represented major insurers in more than 100 commercial
bankruptcy cases.
The Firm routinely acts on behalf of insurers as creditors
in commercial bankruptcy matters. We have broad experience
with bankruptcy disputes involving loss-sensitive insurance
programs, captive insurers, security disputes, retro-insurance,
relief from stay motions, alleged preferences, other avoidance
actions, and claims resolution procedures. In addition, the
Firm has an active practice in representing insurers when
insureds file for bankruptcy due to the overwhelming pressure
of toxic tort claims.
The firm also has experience representing bank clients in
prosecuting insured claims involving losses to inventory,
cargo, ships and other collateral.
We also have experience before insurance departments in states
of the United States as well as off-shore in connection with
regulatory matters. ZEK has represented both insurers and
captive reinsurers in the United States and in off-shore proceedings,
and we represent insurers in the negotiation and documentation
of specialized insurance programs.
