Labor and Employment

ZEK advises and represents individuals and companies in matters involving employment practices, policy and procedure, and provides services in connection with the negotiation and drafting of employment contracts, compensation agreements, restrictive covenants, and separation agreements.

In the litigation arena, the Firm's attorneys have extensive experience in litigating cases pending in state and federal courts and the EEOC involving allegations of discrimination based on race, sex, age, national origin, disability and religion. ZEK also has a proven record of success in defending employers against claims of wrongful termination and retaliatory discharge. The Firm also represents employers in breach of contract disputes and in claims involving theories of tort and employment related statutory law and regulations.

Not surprisingly, given the robust current financial climate, ZEK frequently represents employers in "fast track" litigation emerging from the sudden defection of key employees to competitors and the protection of confidential information and trade secrets. ZEK is equally adept in litigating such matters in the state and federal courts and before arbitrators.

Further, the Firm has been involved in union contract negotiations, union arbitrations, proceedings before the National Labor Relations Board and has advised clients in certification and decertification elections.
