David’s driving objective is to maximize the success of the firm’s clients. His efficient, resourceful, and collaborative efforts assist clients to pragmatically navigate complex commercial litigation, governmental investigations, and banking and real estate transactions. He calls on his extensive experience representing financial institutions and real estate owners and managers to craft thoughtful, innovative, and sophisticated strategies aimed at producing the highest return for clients.
David has attained substantial success in a broad spectrum of real estate and banking related litigation, including the counseling of lenders and special servicers in connection with non-performing portfolio and commercial CMBS loans and commercial foreclosures, defending institutional and corporate entities from multifarious allegations, and advising entities and individuals embroiled in business disputes relating to breach of contract, breach of fiduciary duty, fraud, and other business torts. Regardless of the forum or subject, David continually employs exhaustive preparation, skillful negotiation, and persuasive writing to obtain the best possible result.
Additionally, David provides daily operating advice to in-house bank counsel, and regularly assists banks with internal investigations geared toward identifying and addressing compliance risks, and with responding to allegations made by bank clients and inquiries from governmental regulators.
David also utilizes the expertise he has acquired through his years of litigation practice to guide and support the firm’s clients through the negotiation and documentation of asset-based lending, acquisition and real estate financing, remedial workouts, and commercial leasing.
Throughout his career, David has negotiated and drafted profitable agreements, secured judgments for banks, loan servicers, real estate holding companies, and individuals in real estate-related litigations, negotiated favorable settlements for both plaintiffs and defendants in a host of varying lawsuits, obtained emergency injunctive relief for clients facing imminent threat, elicited deposition testimony crucial to support advantageous bargaining positions, and conducted bench trials to judgment in favor of clients.
David joined ZEK in 2012 and is the founding attorney of the firm's Washington, DC office.
